At the end of December 2022, the new law on the regime of foreigners in Romania was promulgated. This includes provisions for foreigners whose residence permit for work purposes/ single permit has expired.
What are the new legal provisions?
According to Art. II of Law no. 382/2022, foreigners who legally entered the territory of Romania and whose single work permit has expired can request a new one, within 90 days from the date of entry into force of the law. The work permit can be renewed if the termination of the employment contract was registered with the more than 18 months before the date of entry into force of the law. This means that if your work permit has expired, you can renew it until April 2023.
In the past, the single permit must have been renewed at least 30 days before the expiration of the previous one.
Is there any exception?
Yes. The provisions do not apply to foreigners to whom the General Inspectorate for Immigration issued the return decision until the date of entry into force of this law, i.e. the return decision was issued before 02.01.2023.
What documents shall I submit in order to renew the work permit?
An application form that can be downloaded from here;
The border crossing document (passport, travel document, etc.), in original and copy;
Proof of legal use of the living space (such as a lease contract), in original and copy;
Individual employment contract;
Salary statement;
Medical certificate that can be issued by any public or private medical institution. It must certify that you do not suffer from diseases that may pose a threat to the public health;
Proof of fees payment. There are two fees that must be paid: 120 euros (equivalent in lei) representing the consular fee and 259 RON representing the equivalent value of the residence permit.
